Harrison County Supervisors Meeting March 30, 2023 Chairman John Straight called the meeting to order with members Tony Smith and Brian Rife in attendance. The tentative agenda was approved on a motion by Smith, second by Rife. Motion carried. Previous minutes were approved on a motion by Smith, second by Rife. Motion carried. Attendance: Auditor Susan Bonham, Paul J. Rhoten, Kori Grosse-Rhode, Chad Grosse-Rhode, Elizabeth Heistand, Molly Rydberg, Mike Rydberg, Mike Hack, Renee Hack, Craig Christians, David Reisz, Kim Reisz, Erin Hudson, Katina Smith, Heath Hack. Cattle Confinement on Niagara Trail Mr. Grosse-Rhode voiced concerns with the cattle confinement being built on Niagara Trail. Others in attendance also voiced concerns with the confinement. A letter from Linda Adair was read. A petition and informational packet were given to the Board of Supervisors. County Attorney Jennifer Mumm offered to review legal materials from the group or from their attorney regarding the cattle confinement. Owners of the confinement are Jeffrey J Allen and Nichole M. Allen. Signs on Courthouse Property A “For Sale” realtor sign was placed in the Highway 30 right of way of the Courthouse. Gabe Madsen whose property was being advertised by the For Sale sign felt the sign should be allowed. City Administrator Angela Winther read from the city and State code that no advertising signs, including realtor signs, are allowed in the right of way. County Attorney Jennifer Mumm reiterated that no signs are allowed in the right of way. The Board agreed that no signs are allowed in the right of way of county property. Opioid Resolution County Attorney Jennifer Mumm reviewed the resolution authorizing the county to enter into the Settlement Agreements with Teva Pharmaceutical Industries Ltd., Allergan Finance, LLC, Walgreen Co., Walmart, Inc., CVS Health Corporation and CVS Pharmacy, Inc. The Harrison County Board of Supervisors hereby approves and authorizes Harrison County Attorney, Jennifer V. Mumm, to settle and release the County’s claims against the Settling Defendants in exchange for the consideration set forth in the Settlement Agreements by taking the following measures: 1. The execution and delivery of the Participation Agreement to the Settlement Agreements and any and all documents ancillary thereto. 2. The execution and delivery of any and all further and other documents necessary to effectuate the foregoing and the terms of this Resolution. The County shall deposit the LG Share in its account titled “LG Abatement Fund” to receive the LG Abatement share from the settlement Agreements. Be it resolved that all actions heretofore taken by the Board of Supervisors and other appropriate public officers and agents of the County with respect to the matters contemplated under this Resolution are hereby ratified, confirmed and approved. Motion to approve by Rife, second by Smith. Motion carried. Broadband Grant The Board signed a letter of support for the broadband grant nominations on a motion by Rife, second by Smith. Motion carried. Mondamin Library Board The Board approved the appointment of Jessica Hopkins as the rural representative to the Mondamin Library Board for a six-year term on a motion by Rife, second by Smith. Motion carried. Engineer County Engineer Steven Struble met with the Board and reviewed the following project updates: Jefferson #1 Bridge over Boyer River on Parker Trail – Contractor has driven 15 piles inside the cofferdam for the east pier footing and will be welding on additional length to those piles this week. The first 30’ of piling have to be extended because they didn’t achieve the bearing requirement. Taylor #12 Bridge on F50 over Allen Creek – County has submitted final construction documentation and payment notification. Morgan #3 Bridge Replacement Project on K-45 South of the Soldier River – County is waiting for the formal wetland determination by our wetland’s consultant in the spring. Truck drivers and blade operators were called out at 7 a.m. on Sunday morning to come in and push snow. We had reports of 6” to 9” of new snow around the County. The trucks were out until 11 a.m. and the blades stayed out until 3:30 p.m. All of the paved routes and the higher traffic rock roads got cleared on Sunday. Engineer Struble discussed the possibility of trading one or two motorgraders. Quotations on four different Cat machines have been received and are waiting for the Ziegler appraiser to look at our two possible trades. A motion to accept the bid from Asphalt Surface Technologies Corp of St Joseph, Minnesota in the amount of $820,869.79, award the associated contract to the same for Federal Aid project STP-S-CO43(95)—5E-43 on Panora Avenue, and authorize and designate the County Engineer to sign the construction contract electronically was made by Smith, second by Straight. Motion carried. Rife voted nay. A motion to accept the bid from Western Engineering Company of Harlan in the amount of $1,492,214.79, award the associated contract to the same for Farm to Market asphalt Project FM-CO43(96)—55-43 on Toledo Avenue, and to authorize and designate the County Engineer to sign the construction contract electronically was made by Rife, second by Smith. Motion carried. The Board approved a utility application agreement from Windstream Communication along the FM Extension of F20/Easton Trail inside the corporate limits of Pisgah to provide service to the Pisgah Community Bank on a motion by Smith, second by Rife. Motion carried. Maximum Levy Notice A public hearing was held for the County’s maximum levy notice. Comments were heard from Rebecca Wilkerson. Motion to close the public hearing was made by Smith, second by Rife. Motion carried. Resolution WHEREAS, the Harrison County Board of Supervisors has considered the proposed FY2023-2024 maximum property tax dollars for the affected levy total; and WHEREAS, a notice concerning the proposed county maximum property tax dollars was published on March 15, 2023 as required and posted to the County’s webpage; and WHEREAS, a public hearing concerning the proposed county maximum property tax dollars was held on March 30, 2023; and WHEREAS, the Board finds this action is in the best interest of Harrison County, Iowa. THEREFORE, be it resolved by the Harrison County Board of Supervisors that the maximum property tax dollars for the affected tax levies for FY2023-2024 shall not exceed the following total: GENERAL SERVICES - $7,297,768 (6.32012 tax rate) RURAL SERVICES - $2,751,057 (3.10006 tax rate) The Maximum Property Tax Dollars requested in GENERAL SERVICES and RURAL SERVICES represents an increase of more than 102% from the current fiscal year ending June 30, 2023. Motion to approve by Smith, second by Rife. Motion carried. FY24 Budget The Board worked on the FY24 budget. Assessor Comments County Assessor Emily Allmon informed the Board of approximately 11,000 assessment notices were being mailed out. Last fall, the new pricing manual from the State was updated and those changes are being reflected on the new assessments. Assessor Allmon stressed that it does not mean that the property taxes will go up by the same percentage, as the levy rates are set by the taxing authorities. Assessor Allmon introduced her newest employee, Dana Riza, to the Board. The Board welcomed Ms Riza to the County. With business of the day completed, the Board adjourned on a motion to adjourn by Rife, second by Smith. Motion carried. Crawford County Chairman Ty Rosburg welcomed everyone, called the meeting to order and conducted the Pledge of Allegiance. Monona County Supervisor Bo Fox made the motion to approve the agenda, second by Crawford County Supervisor Jean Heiden. Unanimous approval. Discussion Consolidating Law Enforcement. * Shelby County and City of Harlan entered a contract at the end of March 2023. No Police chief, City officers went from 8 to 6 for County run Law Enforcement. * Different levels of employment * 5-year contract * Guarantee Harlan 200 hours of coverage. * Monona County has a contract with Onawa and talking with Mapleton about a contract. Pipeline Discussion. * Compaction study, yield reduction, test soils of each class. * Review of IUB. Discussion Sharing Employees. * Monona is looking to share Engineer while posting to hire an Engineer. Discussion of Legislation * DNR ground – accountable to maintain their ground. * 12% overload – Legislation forcing every road.
