Brian Collier, 52, of Honey Creek, has been charged with willful injury in relation to a late June shooting at Papa Joe's in Missouri Valley.
The charge, which is a Class C felony, stems from a June 29 altercation between Collier and the victim, Edward Cox, of Missouri Valley.
According to an affidavit from the Iowa Department of Criminal Investigation, Cox allegedly punched Collier while the two were at Papa Joe's bar in Missouri Valley. Cox was then allegedly escorted out of the bar by fellow patrons, but re-entered the establishment and approached Collier, causing a larger physical altercation to ensue.
This allegedly included Collier's fiance and his fiance's friend. “(Collier) withdrew a firearm from his holster and shot (Cox) multiple times in the torso and arm,” the affidavit states. “(Cox) walked outside before collapsing on the sidewalk.”
From there, Cox was life-flighted to the University of Nebraska Medical Center in Omaha, where he was treated for multiple gunshot wounds to his torso and arm. The altercation took place shortly after midnight.
Collier allegedly fled the scene on his motorcycle, according to the affidavit, and allegedly concealed the firearm used under a bridge near his residence. After that, the affidavit alleges that Collier and his fiance drove to Collier's mother's residence in Council Bluffs.
Collier's initial appearance in Harrison County court was held on July 8. A telephonic preliminary hearing is scheduled for July 22. Jennifer Miralles has been appointed as Collier's public defender.
