City of Modale City Council Meeting Minutes November 13, 2023 The regular meeting of the Modale City Council was held on November 13, 2023. Mayor James Cox called the meeting to order at 7:00 p.m. Councilmembers present were Blair Adams, Kathy Dugdale, Terigene Tiffey and Amber Larsen via telephone. Visitors present were Katie Moyer, Alexis Hernandez, John Moyer, Tammy Cooperrider, Jay Gerke, Randy Wendt, Linda and Carl Anderson, Troy Groth, Chris and Jennifer Skinner, Mariah, Morgan and five (5) other students. Staff present were Marty Skinner, Shauna Gerke and Linda Windschitl. Consent Agenda: Tiffey asked that the funds earmarked for the 150th and Fun Days be moved to that checking account. Adams made a motion to approve the Consent Agenda and Dugdale seconded. Motion passed 3-0-1 with Larsen abstaining. Katie Offenbacker arrived at 7:05 p.m. Public Works: Marty Skinner discussed bids for the parking and door mechanism, as well as sewer drain. He also discussed Windstream’s Fiber Optic installation, which the City was never notified about. A bill from McLaughlin was presented for 105 Haley. Offenbacker made a motion to pay the bill on behalf of the residents, as long as we have an agreement with the homeowners that allows us to then charge them an additional fee on their water bill for the next 12 months. Tiffey seconded the motion. Motion passed 5-0. There were two permits presented. Offenbacker made a motion to approve both, Dugdale seconded. Motion passed 5-0. Marty reported that the first half of the new water meters have been installed and the second half need to be ordered to arrive before spring. Larson was disconnected at 7:29 p.m. Sewer Lagoon: Troy gave a progress update. Significant completion should occur on or before December 8th, with a final payment date of January 5, 2024. An application for payment was submitted in the amount of $144,892.10. Tiffey made a motion to approve the payment of said Application, Dugdale seconded the motion. Motion passed 4-0. Tiffey motioned to approve claims 1-10 that have been submitted to CDBG for funding via the grant, Adams seconded. Motion passed 4-0. The SOFA (Status of Funded Activities) was discussed, and the AFFH notice read. Offenbacker made a motion to table this matter, Tiffey seconded. Motion passed 4-0. Citizen Inquiries: There were no citizen inquiries. Library: Jennifer Skinner reported for the library. They will be requesting the second half of their budget at the December meeting. Fire Department: there was no report. Tiffey reported on some dangerous incidents and Jason will be making a list. Ordinances: Gerke presented the changed ordinances. A public hearing on the new ordinances was opened at 7:50 p.m. There was no public comment, so the hearing closed at 7:56 p.m. Offenbacker made a motion to waive the second and third readings of the proposed ordinances, Tiffey seconded. Motion passed 4-0. Larsen arrived at 8:02 p.m. Mayor Cox read Resolution 2023-14 adopting the City of Modale Code of Ordinances 2023. Dugdale made a motion to adopt said resolution, Offenbacker seconded. Motion passed 5-0. Rent has been paid on the apartment through October 31st. Gerke confirmed the cigarette permit for DeCarlos has expired. No application has been made. The Clerkbooks and Quickbooks training is going well. Future water bills will be sent out on yellow cards. Randy Wendt requested the Deed to 408 N Main Street be released so he could sell the property to Jay Gerke for development. Mayor Cox requested proof of the cost to remove the house on the property to make sure Wendt was not going to profit off the sale. Larsen made a motion to release the deed upon proof of costs. Tiffey seconded the motion. Motion passed 5-0. Jay Gerke requested a building permit for the property once the deed is released. Offenbacker made a motion to approve the building permit with Marty’s approval, Tiffey seconded. Motion passed 5-0. The AFR matter was tabled. The EMA meeting needs a representative from the City. Adams agreed to accept the spot. Items discussed, but no action taken: borrow pit tabled until project is over. 2023 budget workshop was a wealth of information, the monitor cannot be installed in the council chambers at this time. We do not have TIF funds. A letter we received from SWIPCO about affordable housing was shared, as well as the Trees Please grant opportunity. If anyone is interested in heading up and bringing the Crime Stoppers program to Modale, please contact the Harrison County Sheriff’s Office. Items for next month’s agenda: welcome letter updated and sent to new residents. Adams made a motion to adjourn. Larsen seconded the motion; motion carried with a 5-0 vote.
