RESOLUTION NO. 2023-36 RESOLUTION TO APPROVE NON-SUFFICIENT FUNDS PAYMENT POLICY WHEREAS, the City of Woodbine, receives payments from numerous people and organizations and the City of Woodbine wishes to establish a Payment Policy; and WHEREAS, the City of Woodbine currently receives payments in the form of cash and checks and will be adding account debit, credit cards, and debit cards; and WHEREAS, the City of Woodbine currently receives these payments in person, and through the mail and will be adding ACH, and online; and WHEREAS, the City of Woodbine occasionally has payments returned, this could be for insufficient funds, account closed, no account found, fraud, stop payment, and other reasons; and WHEREAS, Section 554.3512 of the 2023 Code of Iowa states “The holder of a dishonored check, draft or order may assess against the maker of that check, draft or order a surcharge not to exceed thirty ($30.00) dollars.”; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Woodbine Iowa, to set the following Payment Policy: 1. A fee of thirty ($30.00) is hereby established for servicing all returned payments received by the City of Woodbine. 2. The City of Woodbine will only accept guaranteed payment (cash, approved card payment, cashier’s check, or money order) from any individual or business who has had a payment returned to the City of Woodbine more than one (1) time in any given period of twelve (12) months. 3. The restriction of guaranteed payment shall last for one (1) year from the most recent returned payment date. 4. Notice of this Payment Policy shall be posted prominently at the City of Woodbine City Hall customer service counter. BE IT FURTHER RESOLVED, by the City Council of the City of Woodbine, Iowa that the Mayor and the City Clerk are hereby authorized and directed to execute said resolution.
