CITY OF MONDAMIN REGULAR CITY COUNCIL MEETING MINUTES Mondamin City Hall Monday, October 3, 2022 7 P.M. 1. Opening of Meeting a. Mayor Pro Tem Karen Breyfogle called the meeting to order at 7:02 p.m., leading those present in the Pledge of Allegiance. b. Roll Call Council members present: John Glennie, Mary Seago, Jim Rains and Terry Coyle. Staff present: Alyx Hirst and Steve Hinkel. Public present: Christine Hussing, John Harrison, Shane Ehlers, Tonya Beck, and Ethan Joy from JEO Consulting. c. Approval of Agenda Clerk Hirst asked to amend the agenda to add [ item l ] “Building Permit at 301 N. Main St.” under New Business. Motion made to approve amended agenda by M. Seago, with a second by T. Coyle. Motion carried 4-0. d. Approval of Minutes T. Coyle made a motion to approve September 7th regular meeting minutes. Seconded by J. Rains. Motion carried 4-0. T. Coyle made a motion to approve September 14th special meeting minutes and it was seconded by J. Glennie. Motion carried 4-0. e. Approval of Claims as Presented M. Seago made a motion to approve all claims as presented. Motion was seconded by J. Glennie. Motion carried 4-0. 2. Public Comments Shane Ehlers was present to discuss purchasing property at 303 Cedar St, removing the home, building a garage for semi-trucks and trailers, and adding living quarters. Council voiced concerns on the weight of the trucks and safety concerns having semi traffic on a street so close to the park and splashpad. Councilman Rains discussed leasing a city owned lot for semi-parking but discussions with the city attorney would be needed. A special council meeting will be held on October 13th to discuss this matter further. 3. Community Center/Facility Report The community center manager sent in her report to the council. 4. Library Report Librarian Christine Hussing reported that the new gaming table was delivered after the original one had an electrical issue. Christine also discussed how wonderful it was to visit West Harrison’s Little Hawks for an after-school story and project. 5. Fire Department Report None 6. Old Business a. City Owned Property: Brown’s Second Addition on North Main Street Tabled 7. New Business a. Public Hearing on the authorization of a Loan Agreement and the issuance of Notes to evidence the obligation of the City thereunder M. Seago motioned to open the public hearing at 8:02 pm with a second by J. Rains. Motion carried 4-0. No written comments were received. No public comments were heard. J. Rains made a motion to close public hearing at 8:03 pm with a second by J. Glennie. Motion carried 4-0. b. Resolution instituting proceedings to take additional action Council Member M. Seago introduced the Resolution instituting proceedings to take additional action for the authorization of a Loan Agreement and the issuance of not to exceed $708,000 Water Revenue Capital Loan Notes and moved that the same be adopted. Resolution was seconded by T. Coyle. Roll call. All ayes. Motion passed unanimously. c. Consideration of construction bids for the water treatment plant upgrade The City received bids on July 14, 2022, at 2:30 p.m. and publicly opened pursuant to the Resolution of the City Council. At said time it was announced that it was time to receive, open, and tabulate bids for the 2020 Water Treatment Plant Upgrade, in accordance with the plans and specifications to be filed with the Clerk. The following bids were received for Group A. RP Constructors of North Sioux City, SD in the amount of $3,605,069.33 and Eriksen Construction of Blair, NE in the amount of $3,888,786.00. J. Rains motioned to consider bids for Group A with a second from M. Seago. Motion carried 4-0. No bids for Group B were received. d. Resolution designating low bidder for the water treatment plant upgrade M. Seago introduced the Resolution designating low bidder on the public improvement project designated 2020 Water Treatment Plant Upgrade and moved that the Resolution be adopted. J. Glennie seconded the motion to adopt. Roll call. All ayes. Resolution duly adopted. This Resolution designates RP Constructors of North Sioux City, SD as the lowest bidder in the amount of $3,605,069.33 for Group A. Group B received no bids and may be rebid later. e. Resolution making award of construction contract M. Seago introduced the Resolution making award of construction contract and moved that the same be adopted. J. Rains seconded the motion to adopt. Roll call vote. All ayes. Motion passed unanimously. This Resolution states that the bid for the construction of certain public improvements identified as 2020 Water Treatment Plant Upgrade, described in the plans and specifications, adopted by the City Council, is accepted, and the same being the lowest responsible bid received for such work is awarded to RP Constructors of North Sioux City, SD in the amount of $3,605,069.33 for improvements in Group A. Group B was not awarded as there were no bids. f. Resolution approving construction contract and bond M. Seago introduced the Resolution approving construction contract and bond and moved its adoption. J. Glennie seconded the motion to adopt. Roll call. All ayes. Resolution duly adopted. This Resolution approves the construction contract and bond surety for RP Constructors. g. Resolution accepting 2020 Water Treatment Plant Upgrade – Group A M. Seago introduced the Resolution accepting public improvements and moved that the same be adopted. T. Coyle seconded the motion to adopt. Roll call vote. All ayes. Motion passed unanimously. This Resolution accepts that the City of Mondamin enter into a contract with RP Constructors for the construction of certain public improvements identified as 2020 Water Treatment Plant Upgrade-Group A. h. Resolution accepting 2020 Water Treatment Plant Upgrade – Group B No action taken i. Ordinance 2022-01: Second reading of the Mondamin Code of Ordinances 2022 J. Rains motioned to approve the second reading of the 2020 Mondamin Code of Ordinances. Motion was seconded by M. Seago. Motion carried 4-0. J. Rains motioned to adopt the 2020 Mondamin Code of Ordinances and wave the third reading. The motion was seconded by J. Glennie. Motion passed unanimously. j. Consideration to repair generator at current water treatment plant Table k. Building Permit: 103 Maple Street T. Coyle motioned to approve building permit at 103 Maple St. The motion was seconded by J. Glennie. Motion carried 4-0. l. Building Permit: 301 N Main St. T. Coyle motioned to approve building permit at 301 N Main St. Motion seconded by J. Glennie. Motion carried 4-0. 8. Mayor’s Report None 9. Clerk’s Report Clerk Hirst reported working on The Mondamin Code of Ordinances and the water plant project. 10. Public Works Report None 11. Commissioner Reports King’s Court Commissioner: K. Breyfogle reported that new stoves were installed in all but 2 units at King’s Court because they were damaged. 12. Other Business Special council meeting will be held Oct. 13th at 5:30 p.m. 13. Adjourn Having no further business to conduct, T. Coyle made a motion to adjourn the meeting. Seconded by J. Glennie. Motion carried 4-0.
