ORDINANCE CODE OF CONDUCT FOR CITY FACILITIES BE IT ENACTED by the City Council of the City of Pisgah, Harrison County, Iowa: SECTION 1. Purpose. The purpose of this ordinance is to create a code of conduct for public facilities, including but not limited to city hall and parks and recreation facilities: Code of Conduct for City Facilities. The following conduct is prohibited within City Hall, city parks, and all city-owned facilities: 1. Disruptive Behavior. Any behavior that disrupts or interferes with city operations, public meetings, or recreational activities, including but not limited to shouting, excessive noise, or refusal to follow instructions from city officials. 2. Violence and Threatening Behavior. Engaging in any act of violence, assault, physical intimidation, or threats of violence against any individual, including city employees, officials, or other visitors. 3. Vandalism and Damage to Property. Defacing, damaging, or destroying any city property, including buildings, equipment, landscaping, and recreational facilities. 4. Public Intoxication. Being under the influence of alcohol or illegal drugs in a manner that causes a disturbance or endangers the safety of others. This includes open consumption of alcoholic beverages, except in designated areas authorized by the city. 5. Trespassing. Entering any city facility or park area that is closed to the public or restricted without proper authorization, including after posted hours. 6. Loitering. Loitering on city property in a manner that impedes the flow of traffic or obstructs the use of city facilities. 7. Harassment. Verbal, physical, or sexual harassment, including inappropriate comments, gestures, or advances directed at city employees, officials, or visitors. 8. Smoking and Use of Tobacco Products. Smoking or using tobacco products, including electronic cigarettes (vaping), in any area where such activity is prohibited by posted signs or city regulations. 9. Illegal Activity. Engaging in any activity that violates federal, state, or local law, including but not limited to drug use, gambling, and the possession of illegal weapons. 10. Littering. Disposing of waste, trash, or other materials in a manner that is not compliant with posted city waste disposal guidelines. All waste must be placed in designated containers. 11. Unauthorized Commercial Activity. Selling or offering for sale any goods, services, or merchandise on city property without a permit or authorization from the city. Enforcement and Penalties 1. Authority to Enforce: City employees, law enforcement officers, and other designated personnel are authorized to enforce this Code of Conduct. 2. Penalties: Any person violating the provisions of this chapter may be guilty of a simple misdemeanor and, upon conviction, be subject to a fine of up to six-hundred twenty-five dollars ($625) and imprisonment not to exceed thirty days (30). 3. Immediate Removal: In addition to any penalties, individuals found violating this Code may be immediately removed from city property by city personnel or law enforcement officers. SECTION 2. Numbering. The ordinance shall be assigned an appropriate chapter and number in the City Code by the Clerk. SECTION 4. Repealer. All ordinances, resolutions, and motions of the City Council in conflict with this action are hereby repealed. SECTION 5. Effective Date. This ordinance shall be effective from and after its final passage, approval and publication as provided by law.
