ORDINANCE NO. 618 AN ORDINANCE AMENDING SEWER RATES WHEREAS, the City Council of the City of Missouri Valley, Iowa, finds it necessary to amend the method of calculating sewer service charges in Section 99.02, subsections 1, 2, and 3; and WHEREAS, the City Council also finds it necessary to repeal Section 99.03 of the City Code; and WHEREAS, it is deemed equitable and reasonable that sewer charges be based on a percentage of water usage. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MISSOURI VALLEY, IOWA: SECTION 1. AMENDMENT. Section 99.02, subsections 1, 2, and 3 of the City Code are hereby amended to read as follows: For the first 1,000 gallons or fraction thereof – $13.50 within the City limits and $19.50 for service outside the City limits – minimum monthly charge Sewer charges shall be calculated based on the water usage recorded on the customer’s water meter for the corresponding billing period. The billing shall appear as a separate line item on the utility statement. For each additional 1,000 gallons or fraction thereof – $5.50 per 1,000 gallons within the City limits and $7.50 per 1,000 gallons for service outside the City limits. Subsection 3 of Section 99.02 is repealed. Any conflicting language in subsections 1, 2, or 3 of Section 99.02 is hereby repealed. SECTION 2. REPEAL. Section 99.03 of the City Code is hereby repealed in its entirety. SECTION 3. REPEAL OF CONFLICTING ORDINANCES. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 4. SEVERABILITY. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any part thereof not adjudged invalid or unconstitutional. SECTION 5. EFFECTIVE DATE. This ordinance shall be in full force and effect on October 1, 2025, after its passage, approval, and publication as provided by law.
