CITY OF MONDAMIN REGULAR CITY COUNCIL MEETING MINUTES Mondamin City Hall Wednesday, September 7, 2022 7 P.M. 1. Opening of Meeting a. Mayor Jamie Howrey called the meeting to order at 7:00 p.m., leading those present in the Pledge of Allegiance. b. Roll Call Council members present: John Glennie, Karen Breyfogle, and Mary Seago. Absent: Jim Rains and Terry Coyle. Staff present: Alyx Hirst and Steve Hinkel. Public present: Christine Hussing, John Harrison, and Brian Rife. c. Approval of Agenda Clerk Hirst asked to amend the agenda to add [ item i ] “VC3 Quote” under New Business. Motion made to approve amended agenda by K. Breyfogle, with a second by J. Glennie. Motion carried 3-0. d. Approval of Minutes J. Glennie made a motion to approve August 1st regular meeting minutes. Seconded by K. Breyfogle. Motion carried 3-0. J. Glennie made a motion to approve August 30th special meeting minutes and it was seconded by K. Breyfogle. Motion carried 3-0. e. Midwest Coatings Invoice (Street Maintenance & Repairs) J. Glennie made a motion to approve Midwest Coatings invoice in the amount of $134,635.05. The motion was seconded by K. Breyfogle. Motion carried 3-0. f. Approval of Claims K. Breyfogle made a motion to approve all other claims as presented. Motion was seconded by M. Seago. Motion carried 3-0. 2. Public Comments Brian Rife was present on behalf of his aunt, Sheryl Rife, to discuss her dilapidated mobile home at 100 South Harding. Brian read a statement from his aunt stating that she feels targeted with all the notices that have been sent regarding her property. Brian referenced Sheryl receiving a weed notice when Brian himself did not receive one during the same timeframe and his grass hadn’t been mowed either because both he and his father were in the field. Sheryl also stated that she received a second notice on the dilapidated property but never did receive a first notice. Sheryl stated that she feels like she is being harassed and would like it to be on public record that no persons representing the City of Mondamin be allowed on her property without her consent and any persons found on her property will be charged with trespassing. Council member John Glennie then asked what course of action should follow. Clerk Hirst stated that we need to follow up with the attorney. City Property Maintenance Inspector, John Harrison from Bluffs Inspection Services replied that the city ordinance states grass can not be more than 12 inches tall and that the grass was well over a foot tall when the notice was posted, and it was mowed between the time given so there was no issue. John stated that as for the first dilapidated notice that wasn’t received, he does not have control over the mail system and whether Sheryl received it. John then asked Brian as a member of the fire department, if he had concern of the dilapidated structure being a fire hazard for which Brian responded, “not really because there is no power going to the structure”. Clerk Hirst then asked how many years the home has been unoccupied which then Brian responded, “20 years”. Council member Mary Seago stated that from an outside perspective from the first meetings we (council and housing assessment members) had with the Iowa State Extension regarding dilapidated properties, it was important that we create these new ordinances so we can remove these abandoned homes, build new homes, increase our tax base, and increase our school enrollment. 3. Community Center/Facility Report The community center manager sent in her report to the council. 4. Library Report Christine Hussing, librarian, reported on the new reading program with West Harrison’s Little Hawks regarding the after-school story and project. Christine also stated that the new game table was not working due to a power surge. Council asked Steve to call MidAmerican to see what can be done so this does not happen again. 5. Fire Department Report None 6. Old Business None 7. New Business a. Public Hearing on the Proposed Mondamin Code of Ordinances 2022 K. Breyfogle motioned to open the public hearing at 7:42 pm with a second by M.Seago. Motion carried 3-0. No written comments were received. No public comments were heard. K. Breyfogle made a motion to close public hearing at 7:45 pm with a second by M. Seago. Motion carried 3-0. b. Ordinance 2022-01: First reading of the Mondamin Code of Ordinances 2022 Motion made by M. Seago to approve the first reading of the Mondamin Code of Ordinances 2022. Motion seconded by K. Breyfogle. Roll call. All ayes. Motion passed unanimously. c. L.O. Sandbar: Liquor License Renewal 10/2/2022 – 10/1/2023 K. Breyfogle made a motion to approve the liquor license for L.O. Sandbar and it was seconded by M. Seago. Motion carried 3-0. d. Final Plat Map Consideration of Brown’s Second Addition on North Main Street Clerk Hirst reported that she emailed the map to city attorney, Todd Argotsinger, and he saw no issues with the map. J. Glennie motioned to approve the plat map and it was seconded by M. Seago. Motion carried 3-0. e. West Central Community Action: Water Assistance Program LIHWAP Clerk Hirst stated that the new renewal period was coming up and wondered if it was in the city’s best interest to renew our contract for assistance with West Central. Clerk Hirst stated that there were 4 changes to the program, some of which were better than the contract from last year. Clerk Hirst stated that her biggest issue with this program is because once approved from LIHWAP, the city can’t shut customers off even if they are behind on their garbage and landfill fees. Other issues that have come up include residents expecting LIHWAP to pay and even if they are approved, it takes about 45 days to receive payment which then interferes with the following billing cycle. This causes accounting issues with the Clerk having to manually enter each line item for payment which take a lot of extra time and incorrectly calculates finance charges of customers participating in the program. After careful consideration M. Seago motioned to opt out of the water assistance program. The motion was seconded by J. Glennie. Motion carried 2-1 with a nay from K. Breyfogle. f. Building Permit: 307 Chestnut St. K. Breyfogle made a motion to approve the building permit for a fence at 307 Chestnut St. M. Seago seconded the motion. Motion carried 3-0. g. Skid Loader: Consideration for New Tires K. Breyfogle motioned for Steve Hinkel to purchase four new tires for the skid loader. The motion was seconded by J. Glennie. Motion carried 3-0. h. ICAP Grant Ideas After consideration, Council asked if Clerk Hirst would reach out to ICAP and see if electrical repairs for the library would an appropriate grant request and report back next month. i. VC3 Quote Clerk Hirst handed council a bid for a new computer for her office. Alyx stated that when we had the cybersecurity installed, the computer technicians stated that the current computer is bogged down because it is a computer meant for home use and not specific to the work done at city hall. VC3 quoted $1612.40 for a new desktop and a wireless network adapter. K. Breyfogle motioned to approve the quote from VC3 and it was seconded by J. Glennie. Motion carried 3-0. 8. Mayor’s Report Mayor Howrey reported receiving a call on garbage. 9. Clerk’s Report Clerk Hirst reported receiving many inquiries for cat traps for T&R Day on the 13th. She also wanted to remind council of the city clean up day on the 18th. 10. Public Works Report S. Hinkel discussed the new street repairs, the storm sewer clean outs, and the water main break at the school. 11. Commissioner Reports King’s Court Commissioner: K. Breyfogle asked S. Hinkel to get the new stoves installed at King’s Court as soon as he could. 12. Other Business Splash pad will be turned off within the week. 13. Adjourn Having no further business to conduct, K. Breyfogle made a motion to adjourn the meeting. Seconded by M. Seago. Motion carried 3-0.
